General terms and conditions of business

1. Scope of application

1.1 These General Terms and Conditions (GTC) shall apply to all orders placed via the “esimforyou” online store.

1.2 The sale of eSIM cards is made exclusively to consumers within the meaning of § 13 BGB (German Civil Code).

1.3 Deviating or supplementary terms and conditions of the buyer shall not become part of the contract unless they have been expressly confirmed in writing.

2. Subject matter of the contract and contractual partners

2.1 “esimforyou” shall broker the purchase of an eSIM card. The buyer orders the eSIM card via our online store, whereupon it is purchased from a third-party provider in Singapore and sent to the buyer.

2.2 The Buyer's contractual partner is esimforyou, represented by Seyit Arar.

2.3  The use of the eSIM card requires a compatible end device. The buyer himself is responsible for ensuring that his device fulfills the technical requirements.

3. Conclusion of contract

3.1 The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to order.

3.2 By completing the order process, the buyer submits a binding offer to purchase.

3.3 Acceptance is effected by the order confirmation by e-mail or by providing the eSIM card data.

4. Prices and terms of payment

4.1 All prices are inclusive of VAT, where applicable.

4.2 Payment is made exclusively via the following payment methods:

• PayPal

• Credit card (VISA, Mastercard)

• Google Pay

• Apple Pay

• Klarna

4.3 The purchase price is due immediately and will be collected upon confirmation of the order.

5. Delivery and provision of the eSIM card

5.1 The eSIM card is provided digitally. After successful payment, the buyer will receive the necessary activation data by e-mail.

5.2 Delivery usually takes place within a few minutes to 24 hours after receipt of payment.

6. Right of withdrawal

6.1 Consumers are generally entitled to a right of withdrawal in accordance with § 355 BGB.

6.2 The right of withdrawal expires prematurely if:

• the eSIM card has been activated, or

• mobile data has been used

6.3 The revocation must be declared in text form (e.g. by e-mail) and sent to the following address: support@esimforyou.de

6.4 In the event of an effective revocation, the purchase price will be refunded within 14 days of receipt of the revocation.

7. Warranty and liability

7.1 The statutory warranty rights shall apply.

7.2 “esimforyou” shall not be liable for disruptions in the mobile network or technical incompatibilities of the eSIM with the end device of the purchaser.

7.3 Liability for slight negligence is excluded insofar as there is no breach of essential contractual obligations or physical injury or damage to health.

8. Data protection

8.1 The personal data required for order processing will be processed in accordance with the applicable data protection regulations.
8.2 Further information on data processing can be found in the “esimforyou” privacy policy.

9. Final Provisions

9.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

9.2 Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

9.3 The place of jurisdiction for all disputes arising from or in connection with this contract shall be the registered office of “esimforyou”, provided that the customer is a merchant.
